Terms & Conditions

Welcome to NOCO Accents! We aim to ensure a smooth remodeling experience for our clients. Please read our Terms & Conditions carefully to understand our policies before engaging our services.

Quote

A quote from NOCO Accents constitutes an offer to facilitate and coordinate the work described at the specified contract price. All quotes, including any revisions, are valid for 28 days from the date of issue or until the next Bulk Procurement Order (BPO) is placed, whichever occurs first. After this period, NOCO Accents reserves the right to adjust pricing, terms, and material costs as necessary. Each revised quote will detail the proposed work, and only items explicitly stated in the quote will be included in the project.

Retainers, Draw Payments & Final Payment

To formally engage NOCO Accents, a non-refundable initial retainer is required 14 to 180 days before planning or work commences. Payment of the retainer signifies acceptance of these terms and the project specifications outlined in the most recent agreement, proposal, or CAD renderings. Clients acknowledge that timely draw payments are essential to maintaining project schedules and uninterrupted progress. NOCO Accents may request draw payments throughout the project as work progresses and materials are procured. If a requested draw payment is not received when due, NOCO Accents reserves the right to pause work until payment has been received. Written notice of any payment due will be provided, and work will resume promptly upon receipt of the outstanding balance.

The remaining project balance is due upon Substantial Completion and completion of the final walk-through. Any unpaid balance not received within seven (7) calendar days of the due date shall accrue interest at a rate of 8% per annum on the outstanding amount, in accordance with Colorado Revised Statutes § 5-12-102.

Permits

Clients are responsible for all permit and licensing fees, which may vary by county and municipality. Upon receipt of these fees, NOCO Accents will forward the amounts along with any applicable convenience charges. Permit fees should be paid promptly to avoid delays in the construction process.

Inspections

Clients will be notified in advance of scheduled inspections. It is the client’s responsibility to ensure that someone is present at the property for the entire inspection day. Failure to provide access may result in a failed inspection, which may lead to additional fees.

Client Responsibilities

1. Access for Deliveries

Clients are responsible for ensuring that scheduled material deliveries can be received and unloaded as planned. Any redelivery fees, storage fees, or additional charges incurred as a result of denied deliveries or restricted access shall be charged to the client and are due in full at the time of receipt. Delays caused by denied deliveries may result in project schedule adjustments.

2. Site Access

Clients are responsible for providing access to the property during scheduled work hours. If access will be restricted, special entry instructions are required, or work needs to be paused, clients must notify NOCO Accents in advance. Delays caused by lack of access may impact the project schedule.

3. Child Safety

Children must remain away from the construction area for their safety.

4. Pet Safety

Ensure that animals and pets are kept away from the construction site.

5. Site Conditions

Understand that the construction site will be dusty and messy. NOCO Accents will maintain a reasonably organized work area throughout the project; however, final cleaning will be performed only upon project completion.

6. Work Hours

Work will be conducted during two scheduled timeframes for our trades to arrive.

• Morning: 7 AM to noon

• Afternoon: Noon to 5 PM or later (you will be notified if we need to extend past 5 PM).

7. Personal Belongings

  • Removal of Items: Clients are responsible for removing any personal belongings from the construction site prior to the start of work. This includes, but is not limited to, items such as pool tables, furniture, artwork, and any other valuables.
  • Liability Disclaimer: NOCO Accents is not responsible for any damage to personal items left on-site during the construction process. Maintaining a clear workspace helps ensure a safe and efficient work environment. Clients are encouraged to remove any items that could impede construction activities or be susceptible to accidental damage. So, please take a moment to clear the area of anything that might be in the way or that you wouldn’t want to see accidentally damaged!

8. Storage of Appliances

In the event that NOCO Accents removes appliances for the purpose of remodeling, clients acknowledge and agree that NOCO Accents shall not be responsible for any damage that may occur to these appliances while in storage within the client’s home.

Project Changes, Delays & Scheduling

NOCO Accents strives to maintain project schedules; however, unforeseen delays may occur due to factors beyond our control, including material shortages, supply chain disruptions, transportation delays, weather events, labor shortages, permit processing, inspections, or other circumstances affecting project progress.

Clients acknowledge that such delays may impact project timelines and do not constitute a breach of contract by NOCO Accents. In the event of a significant delay, NOCO Accents will provide timely communication regarding the nature of the delay, its anticipated impact on the schedule, and any available alternatives. Updates will be provided as appropriate throughout the duration of the delay.

Any client-requested changes to the project scope, materials, selections, design, or construction plans may result in additional costs, schedule adjustments, or both. All changes must be approved through a written change order before the additional work is performed.

Delays resulting from the client’s failure to provide site access, receive deliveries, make required selections, approve change orders, or submit payments when due shall not constitute delays caused by NOCO Accents.

Timeline Adjustments: Changes may affect the project schedule, and we will communicate necessary adjustments.

Upon signing your agreement with NOCO Accents, you will receive access to your Houzz Pro Client Dashboard. This dashboard will be used throughout your project to keep communication, scheduling, and selections organized.

This warranty does not cover:

• Natural wear and tear that occurs during normal usage.

• Damage resulting from misuse, abuse, accidents, or alterations.

• Products that have been improperly cared for or maintained.

• Concrete and Flatwork: This warranty specifically excludes any issues related to concrete and flatwork, as these materials can be subject to environmental conditions and settling that are beyond our control.

2. Documentation: Include a detailed description of the issue, photographic evidence, and proof of purchase.

3. Review: Upon receipt of your claim, NOCO Accents will review the information provided.

Limitations

This warranty is non-transferable and applies only to the original purchaser. NOCO Accents is not liable for any incidental or consequential damages arising from the use of its products.

Site Access & Landscaping Disclaimer

Owner acknowledges that normal construction activities, including worker foot traffic, material deliveries, and transportation of tools and materials to and from the work area, may result in minor damage or wear to existing landscaping and turf areas. This may include worn grass paths, soil disturbance, mud, or minor damage along access routes surrounding the project area.

NOCO Accents and its trade partners will use reasonable care to minimize impact to the property; however, repair or restoration of lawn, grass, irrigation, landscaping, or other exterior surfaces affected by normal construction access and operations is excluded from the scope of work unless otherwise specified in writing.

Client Responsibilities for Dumpster Accessibility

1. Provision of Space

The Client agrees to provide adequate space for dumpsters on the property during the remodeling project. This space must be easily accessible for delivery and pickup.

2. Location

The specific location for the dumpsters will be determined in consultation with the NOCO Accents. The Client must ensure that this location is free of obstacles and hazards to facilitate safe access.

3. Duration

The Client understands that dumpsters may be required at various stages of the remodeling process. The Client agrees to maintain access to the designated area for the duration of the project.

4. Liability

The Client shall be responsible for any damage incurred due to failure to provide adequate access or for any delays caused by restricted access to the dumpsters.

5. Notification

The NOCO Accents will provide reasonable notice to the Client regarding when dumpsters will be needed, allowing the Client to prepare the designated area accordingly.

Cancellations

We understand plans can change. The following cancellation policy applies:

Before Work Commences: Written notice is required. Initial retainers will not be refunded.

After Work Has Begun: Clients are responsible for payment covering all labor, materials, and expenses incurred up to the cancellation date, plus a 20% cancellation fee of the remaining project balance.

Special-Order Materials: Non-refundable; clients are responsible for full payment of any special-order items.

Notice Period: A minimum of 7 business days’ notice is required to avoid additional charges.

Disputes

Any disputes regarding invoices or work must be submitted in writing within five days of the invoice date. If no notification is received, payment is due as specified.

Important Notes

• NOCO Accents is not responsible for damage caused by movement or vibration during work.

• Clients must inform us of the location of any cables or pipes before work begins.

• Clients are responsible for maintaining the home’s filtration system during the project.

Substantial Completion and Acceptable Construction Tolerances

The Project shall be deemed Substantially Complete when the work is sufficiently complete in accordance with the scope of work so that the project can be occupied, used, or operated for its intended purpose. Minor corrections, punch-list items, touch-ups, warranty items, delayed materials, or cosmetic imperfections shall not prevent a determination of Substantial Completion.

The Owner acknowledges that residential construction, remodeling, and installation work involve industry-standard tolerances and variations. Certain finished elements, including but not limited to cabinets, countertops, plumbing fixtures, tubs, drains, flooring, tile, trim, lighting, hardware, and other installed components, may not be perfectly centered, level, plumb, symmetrical, or dimensionally exact due to existing site conditions, structural limitations, manufacturing tolerances, field measurements, material characteristics, or other factors inherent to construction. Variations that fall within generally accepted industry standards and do not materially affect the functionality, safety, intended use, or appearance of the Project shall be considered acceptable and shall not constitute defective work.

Minor dimensional discrepancies, alignment variations, or measurement deviations that do not materially impair the functionality, operation, or intended purpose of the installed item shall not delay, prevent, or negate a determination of Substantial Completion.

Upon Substantial Completion, all remaining balances shall become immediately due and payable regardless of the existence of punch-list items, touch-ups, warranty items, or other minor corrective work. NOCO Accents shall complete any remaining items within a reasonable timeframe, subject to material availability, scheduling, weather conditions, manufacturer lead times, and other factors beyond NOCO Accents’ control.

The parties agree that payment shall not be withheld for items that fall within accepted construction tolerances or that do not materially impact the use, safety, or functionality of the Project.
